General Terms and Conditions of the WakeWin App

Effective: October 22, 2026

Also available in German: Deutsche Fassung

§1 Scope

These General Terms and Conditions (T&C) govern the use of the mobile application "WakeWin" (hereinafter "App"), provided by Tim Leonsteyn, Schedelstr. 2, 80687 Munich, Germany, support@wakewin.app (hereinafter "Provider"). By registering for and using the App, the user agrees to these T&C.

§2 Service Description

The App provides a smart alarm clock with a photo check and cognitive tasks. To dismiss an alarm, the user must — where Photo Verify is active — first photograph a household object shown by the App, and then solve the required number of tasks (e.g. mental arithmetic), subject to a minimum puzzle duration: at least 5 tasks and a minimum of 30 seconds in standard mode (8 tasks after using the snooze function, with app version 1.2 or later), or at least 8 tasks and a minimum of 45 seconds in Hard Mode (see below). Each wrong answer extends the time before the alarm can be dismissed by 5 seconds. Photo Verify is available to all users and is switched on for every alarm; Premium users can switch it off per alarm. Core features include: streak tracking and multipliers, achievements, Photo Verify, motion verification (pedometer-based physical-movement check before dismissal), music or nature sounds during the challenge phase, multiple alarms, a sunrise analog clock, and full localisation in 14 languages. The App is built on Apple's AlarmKit and requires iOS 26 or later; the iPad version runs in 'Designed for iPhone' mode. Hard Mode is an optional global setting that enforces a stricter rule set on every alarm (Photo Verify required, 8 puzzles minimum, 45-second floor, Medium+ difficulty, motion verification, one snooze allowed, after which 13 puzzles are required); motion verification and Photo Verify are also on for every alarm independent of Hard Mode; Premium users can switch them off per alarm. The Provider offers an optional premium subscription (see §4 for prices and included features). Users may also sign in using Google or Apple accounts.

§3 Registration and User Account

Registration for the App requires an Apple or Google account, or a valid email address and a password; when registering with an email address and password, the email address must be confirmed. The user is obligated to provide truthful information. During profile setup, only the first name is requested (required). The country is determined automatically (see Privacy Policy §2) and can be changed in the profile settings. Further details, such as a username, last name, phone number and address, are optional. The minimum age for use is 18 years; by registering or signing in, the user confirms being at least 18 years old. The user may permanently delete their account at any time via profile settings. All associated data will be irreversibly removed.

§4 Premium Subscription

The Provider offers an optional premium subscription (monthly or yearly) at the prices shown in the App Store before purchase (in Germany currently €7.99 per month or €44.99 per year). Free users earn base tickets for each successfully completed challenge (used for streaks, achievements and personal statistics) and the same number of sun-tickets for the Shop (see §6), but their prize-tickets are not entered into the monthly prize drawing. With the premium subscription, the user additionally receives: bonus tickets for puzzles solved beyond the required number within the minimum puzzle duration; 2 streak freezes included per calendar month (see §6); the option to buy a streak freeze in the Shop while fewer than 2 streak freezes are available (see §6); the Perfect Month reward (see below); and, for a paid subscription, eligibility to enter the monthly prize drawing (subject to the Sweepstakes Terms; premium access granted free of charge by the Provider does not count). Photo Verify is available to all users free of charge.

Perfect Month reward: A premium user who meets all Perfect Month criteria shown in the App during a calendar month receives 750 sun-tickets (see §6). A user who paid for their own premium subscription through the App Store during that month also receives one free month of that subscription, which they claim in the App. The free month starts on the subscription's next renewal date, so the next payment is charged after the free period instead of on that date. If the subscription has already ended, claiming restarts it with the free month, after which it renews at the regular price unless cancelled. A claim is held back only while a running subscription is not set to renew automatically or has an open payment problem. Free months that a user has earned but not yet claimed are claimed together, as one App Store offer of the longest length the App Store offers (1, 2, 3, 6 or 12 months) that does not exceed them. If an earlier free offer is still waiting to start, the new offer replaces it and includes its months, so that no earned month is lost; where no longer offer is possible, the remaining months can be claimed once the earlier offer has started. If the App Store does not apply a claimed free month, the month can be claimed again. Premium access granted free of charge by the Provider (for example through a creator program) receives the sun-tickets but no free month. The reward cannot be exchanged for money.

The subscription may be cancelled at any time effective at the end of the current billing period. Cancellation is handled through the respective app store platform (Apple App Store or Google Play Store).

§5 Sweepstakes

Participation in the sweepstakes is subject to separate participation terms, which can be viewed in the App under "Sweepstakes Terms." Prize-tickets take part in the drawing only if they were earned while the user had a paid premium subscription, and only if the user has enabled sweepstakes participation in the profile settings at the time of the drawing (Sweepstakes Terms §3). Alternatively, free participation by postcard is possible (see Sweepstakes Terms §10).

§6 Shop and Sun-Tickets

The App awards two kinds of tickets (together “tickets”): prize-tickets, which are the entries in the monthly prize drawing under the Sweepstakes Terms, and sun-tickets, which can only be used in the App's Shop. Sun-tickets are credited only as follows: for each successfully completed challenge, the same number of sun-tickets as prize-tickets (Sweepstakes Terms §3); for a referral, 100 sun-tickets when the invited friend completes their first challenge and another 100 when that friend becomes a Premium user for the first time; for badges (achievements), 50 sun-tickets per bronze, 150 per silver, 400 per gold and 1,000 per diamond badge; for each Perfect Month reward from October 2026 onwards, 750 sun-tickets (§4); and by manual credit from the Provider. Postcard entries (Sweepstakes Terms §10) earn no sun-tickets. Tickets and badges earned before the Shop was introduced count as well. A badge pays sun-tickets only while the Provider's server confirms that its conditions are met; this also applies to badges unlocked before the Shop was introduced. A badge for reaching a number of tickets pays only once the prize-tickets earned from challenges and referrals reach that number. If a badge is retired or its conditions are tightened, its sun-tickets lapse. Sun-tickets cannot be bought, are never paid out or exchanged for money, have no cash value and cannot be transferred or sold. Spending sun-tickets never adds, removes or changes prize-tickets. If tickets are removed or voided, for example because they were credited in error or because of a violation of §7, or if a badge's sun-tickets lapse, the sun-ticket balance can fall below zero.

In the Shop, sun-tickets can be spent on unlocks of content, such as songs and app themes, and, for Premium subscribers, on streak freezes, at the prices shown in the Shop. The Provider may change prices; a change applies only to later purchases. While the sun-ticket balance is lower than an item's price, the item cannot be bought. An unlock is a non-exclusive, non-transferable licence to use the content within the App; it does not transfer ownership of the content. If unlocked content has to be removed from the App, for example because a licence for it ends, the sun-tickets spent on unlocking it are credited back to the user. A streak freeze covers one missed alarm day, so that the streak and its multiplier tier continue; how freezes are used, and the mornings at 1× that follow, are set out in Sweepstakes Terms §3. Every user has 2 starter streak freezes, once; they do not expire. Streak freezes can be bought only by a user who is a Premium subscriber at the time of purchase; a streak freeze bought during Premium can still be used after the subscription has ended. Premium subscribers additionally have 2 streak freezes included for each calendar month. A user never has more than 2 streak freezes available at a time: the starter streak freezes not yet used, the bought streak freezes not yet used and, for Premium subscribers, the included streak freezes of the current calendar month not yet used count as available, up to a total of 2. Every user therefore starts with 2 streak freezes, and a Premium subscriber has 2 available again at the start of every calendar month. A streak freeze can be bought only while fewer than 2 streak freezes are available. For each missed alarm day, the included streak freeze of that day's calendar month is used first, then a starter streak freeze, then the oldest bought streak freeze. Streak freezes are only used for challenges completed with app version 1.2 or later. A day covered by a streak freeze still counts as missed for the Perfect Month reward (§4) and for the Perfect Month and Perfect Quarter badges. When the user account is deleted (§3), the sun-ticket balance, all unlocks and all streak freezes are deleted with it and cannot be restored.

§7 Rules of Conduct

The user agrees to use the App only for its intended purpose. The following are specifically prohibited: using scripts, bots, or automated tools to solve tasks; manipulating the device's system clock; intentionally muting or lowering the volume during challenges; creating multiple accounts to gain an unfair advantage. In case of violations, the Provider reserves the right to exclude the user, void earned tickets, and suspend or delete the user account.

§8 Limitation of Liability

The Provider does not guarantee uninterrupted availability of the App. Maintenance, technical disruptions, or force majeure may lead to temporary limitations. Liability for indirect damages, lost profits, or data loss is — to the extent permitted by law — excluded. Liability for intent and gross negligence, as well as for damages resulting from injury to life, body, or health, remains unaffected.

§9 Data Protection

Protecting users' personal data is of great importance to the Provider. Details on the collection, processing, and use of personal data are described in the Privacy Policy, which can be accessed in the App under "Privacy Policy."

§10 Changes to the T&C

The Provider reserves the right to amend these T&C at any time. Changes will be communicated to the user at least 14 days before taking effect via email or in-app notification. If the user does not object to the amended T&C within 14 days of receiving the notification, the new T&C are deemed accepted. In the event of an objection, either party is free to terminate the usage relationship.

§11 Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is — to the extent permitted by law — the Provider's registered office. Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely achieves the economic purpose of the invalid provision. If the language versions of these terms differ, the English version prevails.
